On Wednesday , the Allahabad High Court expressed displeasure on how no action was taken against the erring official and how the investigation was being conducted in the case where a body of a 16-year-old girl was found hanging in the school.
The Court further noted that the case was not briefed to the DGP
The Bench of Acting CJ MN Bhandari and Justice Anil Kumar Ojha adjourned the case for one day and asked the DGP, UP and members of the SIT to remain present and explain what progress has been made by the police and why disciplinary action against the then SP, Uttar Pradesh couldn’t be completed before his retirement.
The Bench also directed Senior Counsel Amarnath Singh to appear for the petitioner.
In the instant case, the body of a sixteen-year-old girl was found hanging in her school.
On the last date of hearing, the Bench noted that even though the incident occurred on 16.09.2019 and the FIR was lodged on 17.09.2021 the police did not interrogate the accused immediately but did it almost after three months.
The High Court had remarked that the Investigating Officer was unable to explain the delay and the post mortem report showed ligature marks and no other injuries. When the Court asked for the photographs of the girl, it was informed that the photographs were not available even though it was submitted that a video was recorded.’
The Court was informed that Superintendent of Police, Mainpuri was shifted and facing a disciplinary inquiry and it was due to his misdeeds in the case investigation, the report showed semen in the vagina and sperms in undergarments.
Lastly, the Court had opined that it cannot be said that the SIT team cannot be said to be independent to probe the case and had directed DGP, UP and members of the SIT to appear before it on the next day.
