The Allahabad High Court while hearing a habeas corpus plea has granted visiting right to the petitioner to meet his child on the first Sunday of every two months to be commenced from 01.12.2021 till further order for the whole day from 10 a.m. to 5 p.m.
“In view of the aforesaid facts and condition of petitioner being fully vaccinated if he abide himself with strict observance of protocol under the pandemic of Covid-19, like sanitization, wearing mask and keeping safe distance, he will have visiting right to the child-Suleiman at given address of the present custodian, mother, the natural guardian i.e. RZ-2977, Fourth Floor-36, Near Hamdard Library Bus Stand, Tuglaqabad Vistaar, Alaknanada, South Delhi-110019, in her care and protection on the first Sunday of every two months to be commenced from 01.12.2021 till further order for the whole day from 10 a.m. to 5 p.m. The opposite party no. 4 shall ensure the visit of child (Corpus) to the petitioner under the aforesaid direction issued by the Court.”

The Single bench of Justice Vikas Kunvar Srivastav has passed the above order while dealing with petition filed by one Suleiman Thru. Father Abdul Allam Waris who is currently in custody of his mother.
The Counsel on behalf of the petitioner, Sri Neeraj Kumar Saxena, has submitted before the court that the petitioner wants to provide a visiting right to the child. He has further submitted that earlier the order of visiting, keeping in view the pandemic situation under Covid19, was ordered through video conferencing but if the position is smoothen now, the personal visit by physically attending at the address of the present custodian (the mother, natural guardian) of the child at Delhi, may be given to him by issuing specific directions.
The Court has noticed that though the pandemic position under Covid-19 is not curbed off completely and still extent danger of infection to any person anywhere, if the guidelines and treatment are not properly followed. The petitioner’s next friend, the father of the child Suleiman, namely, Dr. Abdul Allam Waris who is twice vaccinated may be permitted to visit the child under the terms and conditions as may be prescribed by the Court.
