Recently, a Sessions Court in Ahmedabad increased the monthly maintenance amount payable by a Rajkot businessman to his estranged wife from Rs. 10,000 to Rs.50,000. This decision follows evidence that the husband attempted to conceal his financial status, misrepresenting himself as an account assistant to evade his financial responsibilities.

The court also revised the rental amount for the wife’s accommodation from Rs. 3,000 to Rs. 10,000 per month. The couple, married in 2017, faced significant marital discord, leading the wife to leave her matrimonial home in 2018 and return to her parents in Ahmedabad. Subsequently, she filed a domestic violence case against her husband and in-laws. A family court had initially ordered the husband to pay Rs.5,000 in monthly maintenance. While the husband claimed to earn Rs.54,000 annually as an account assistant in the Gondal market yard, the wife asserted that he and his family were affluent, owning extensive land, multiple residential properties, and a factory producing protein powder, which he denied.

Both parties subsequently filed appeals with the sessions court, with the wife seeking an increase in the maintenance amount and the husband requesting a decrease. The court meticulously examined the husband’s claims of ignorance regarding his family’s financial assets and business operations, which lacked sufficient evidentiary support. It was revealed that his information was available on various business listing platforms, raising questions about his credibility. The court noted substantial inconsistencies in his testimony and concluded that he was attempting to conceal his true financial status.
